[caption id="attachment_6468" align="alignnone" width="300"] DM Kupwara asks general public to refrain from misuse of Social-media networking platforms[/caption] KUPWARA: On Thursday, District Magistrate Kupwara Ayushi Sudan issued an order requesting that the district's populace abstain from any misuse of social media platforms. According to the district magistrate's order, "it has been made to appear that some anti-national persons or groups are resorting to misuse of social-media networking platforms on internet by 'preparing' or 'posting' or 'spreading' or 'propagating' by way of 'forwarding' or 'sharing' incendiary messages and propoganda of terrorist and separatist outfits." According to the order, these activities are being carried out with the intent to: a) glorify terrorists and their actions; b) intimidate and terrorise individuals, the general public, or specific groups within the public; c) encourage members of the public to resort to violence by inciting, encouraging, and spreading disaffection or hatred; d) propagate false narratives and terrorist and secessionist ideology; and e) promote feelings of hatred and ill will based on religion that are likely to disturb public order and tranquilly. "Such acts on part of these anti-national persons or groups are prejudicial to the security of the state, maintenance of law and order and are likely to disturb the public tranquilly" , the order states. It further states that "such acts on the part of these anti-national persons or groups are aimed at terrorising common citizens and public functionaries from discharging their lawful duties." "In exercise of powers conferred upon me (District Magistrate) by section 144 CrPC 1973, I, Ayushi Sudan, IAS, District Magistrate, Kupwara do hereby prohibit and order the general public to refrain from 'posting' or 'uploading' or 'propagating' by way of 'forwarding' or 'sharing' any messages or content as mentioned with immediate effect within the limits of District Kupwara" , the order states. The order states, "This order will come into force with immediate effect."

JAMMU, Nov 30: Director General of Police (DGP) for Jammu and Kashmir, RR Swain, stated on Thursday that social media posts, texts, and videos that could incite violent protests, disturb the peace, or encourage terrorism and separatism will be met with legal action. He quickly added that in an effort to undermine peace and incite violence, J&K police had a duty to make sure that no one attempted to denigrate Prophet Muhammad (SAW) or any other religious community or group. In an interview with reporters in Jammu, DGP Swain stated that he spoke with senior police officers about the situation in Kashmir against the backdrop of a disparaging video that the NIT student had shared on social media."Police will apprehend the anti-social elements, anti-peace elements, and vested interests working on some backdoor agenda after proper investigations," he said. "Any sort of objectionable video, messages, texts, or posts having potential to disrupt peace, vitiate communal frenzy, trigger violence, street protests, promote terrorism and separatists will be strictly dealt as per the law." He advised anyone who receives texts or recordings that might be used to disturb the peace to get in touch with the relevant police station as once. The DGP declared, "The person shouldn't be involved in the dissemination of the text or video that can promote communal harmony and disturb the peace."When asked if political groups that are claimed to seek to incite unrest will face consequences, the DGP responded, "J&K police is the custodian of Law." The legal system would function in such a way that political leaders would be held accountable if a specific action was taken on purpose with malevolent intent and resulted in attacks, property loss, or casualties. According to him, law enforcement officials honour Prophet Muhammad (SAW) and have a duty to ensure that no one disrespects the Prophet (SAW). New Delhi, Nov 30: India said on Thursday that the US accusing an Indian national of planning to assassinate a Sikh separatist on US soil is a "matter of concern" and that a high-level investigative committee will look into the case from all angles. A investigative team has been established by India to look into claims regarding the aborted attempt to kill Gurpatwant Singh Pannun, a Sikh fanatic who is recognised as an American and Canadian citizen. Nikhil Gupta, an Indian national, was accused by US federal prosecutors on Wednesday of collaborating with an Indian government employee in the thwarted assassination attempt against Pannun.On Wednesday, US prosecutors told a Manhattan judge that Gupta was apprehended and held by Czech officials, and that he is presently in the process of being extradited to the US. "This is a matter of concern regarding the case against an individual that has been filed in a US court allegedly linking him to an Indian official," said Arindam Bagchi, a spokeswoman for the External Affairs Ministry. At a press briefing, he stated, "We have said and let me reiterate that this is also contrary to government policy."According to Bagchi, there is a serious connection between international extremism, gunrunning, trafficking, and organised crime. As a result, a high-level inquiry committee has been established, and its findings will undoubtedly guide law enforcement agencies and organisations in their work. According to the MEA spokeswoman, the US side provided certain "inputs" about the relationship between terrorists, gun smugglers, and organised crime. Law On Assault Of Public Servant: Par Panel Suggests Punishment Be Reduced To 1 Yr

New Delhi, Nov 30: After considering the claims made by certain Members of Parliament that the law is frequently "misused," a parliamentary panel has suggested that the two-year jail sentence for anyone who assaults or uses illegal force to prevent a public official from performing his or her duties be lowered to one year. After reviewing the three proposed criminal statutes, the Parliamentary Standing Committee on Home Affairs, led by BJP member Brij Lal, issued the recommendation. Section 353 of the Indian Penal Code (IPC), which is equivalent to clause 130 of the Bharatiya Nyaya Sanhita (BNS), is allegedly "widely misused by public servants in the name of deterrence," according to certain committee members who supplied this information in the report.It was suggested that the punishment under this clause be lowered because political demonstrations are the lifeblood of democracy and because there have been cases in the past where political leaders have been hounded and wrongfully convicted for offences under this section of the IPC while protesting. It stated, "The committee recommends that the punishment provided under clause 130 may be reduced from two years to one year and agrees with the submission made before it." According to BNS clause 130, anyone who assaults or uses criminal force against a public servant while that person is carrying out his or her duties, or who does so with the intention of preventing or discouraging that person from carrying out those duties, or as a result of anything that person does or attempts to do while lawfully carrying out those duties, faces a term of imprisonment of any kind up to two years, a fine, or both. On August 11, the Bharatiya Nyaya Sanhita (BNS-2023) bill, Bharatiya Sakshya Adhiniyam (BSA-2023) bill, and Bharatiya Nagarik Suraksha Sanhita (BNSS-2023) bill were introduced in the Lok Sabha. The three proposed legislation aim to supersede the Indian Evidence Act of 1872, the Indian Penal Code of 1860, and the Code of Criminal Procedure Act of 1898, in that order.
