SC to deliver verdict on pleas challenging abrogation of Art 370 on 11 Dec

NEW DELHI: On December 11, the Supreme Court will rule on appeals contesting the repeal of Article 370 of the Constitution, which granted Jammu and Kashmir unique rights. A bench charged with interpreting the constitution, led by Chief Justice of India D.Y. Chandrachud, had postponed rulings on a number of petitions contesting the central government's action of repealing Article 370 and dividing the state into two union territories until September 5. Justices Sanjay Kishan Kaul, Sanjiv Khanna, Bhushan R. Gavai, and Surya Kant were also members of the five-judge bench.The petitioners contended that with the formation of the State Constitution in 1957 and the dissolution of the Jammu and Kashmir Constituent Assembly, Article 370 had taken on a permanent nature. Representing one of the petitioners, senior attorney Kapil Sibal stressed that Article 370 was not covered by Article 368, which deals with Parliament's power to amend the Constitution. This raised serious concerns regarding the constitutionality of the abrogation procedure. The government argued that the provision was always intended to be temporary and that its abrogation was the final step towards J&K's full integration with the Union of India. Attorney General R. Venkataramani, Solicitor General Tushar Mehta, and advocate Kanu Agrawal represented the government. Along with highlighting the benefits of the repeal of Article 370 in August 2019 and the impending elections, the respondents pointed out a route towards the restoration of full statehood after normalcy was restored. In August 2019, the Indian government made a historic but contentious decision to revoke Article 370 of the Constitution. The Jammu and Kashmir region was granted special autonomous status under Article 370, which gave it the right to have its own flag, constitution, and considerable internal autonomy—with the exception of defence, communications, and foreign affairs. The Union Home Minister Amit Shah and Prime Minister Narendra Modi led the central government in a daring move on August 5, 2019, when they revoked Jammu and Kashmir's special status granted under Article 370. Additionally, the government divided the state into Jammu & Kashmir and Ladakh, two distinct union territories. Ladakh was made into a union territory without a legislature, but Jammu & Kashmir kept its legislature. The abrogation was put into effect by a presidential order that was later approved by the Indian Parliament's two houses. To quell possible unrest, the decision was accompanied by a massive deployment of security forces in the area and a communication lockdown that included limitations on phone and internet services. The Supreme Court of India received petitions challenging the constitutionality of the government's actions following the abrogation of Article 370, setting off a flurry of legal challenges. Proponents contended that it would foster economic growth, guarantee equal rights for all citizens, and open the door for further integration of Jammu and Kashmir into the Indian Union. Opponents countered that it went against the spirit of federalism and jeopardised the region's special status as granted by Article 370.   [caption id="attachment_6871" align="alignnone" width="300"] SC to deliver verdict on pleas challenging abrogation of Art 370 on…

Modi govt did justice to all sections in J&K: Raina

JAMMU: Ravinder Raina, the president of the Bharatiya Janata Party (BJP) in Jammu and Kashmir, stated during a press conference held at the party headquarters in Trikuta Nagar, Jammu, that the government led by Prime Minister Narendra Modi has done justice to all the sections of the state. Ravinder Raina was accompanied on the occasion by Surjit Singh Salathia, J&K BJP Vice-President; Adv. Vibodh Gupta, General Secretary; Dr. Devinder Kumar Manyal, General Secretary; and former Dy. Mayor Baldev Singh Billawaria.Ravinder Raina praised the Modi administration and expressed gratitude to Union Minister for Home Affairs Amit Shah and Prime Minister Narendra Modi for the historic decision to nominate MLAs for the J&K Assembly, which was approved by the Lok Sabha. With this historic move, he said, women, refugees from PoJK, and Kashmiri displaced people would be able to nominate themselves as MLAs in the Jammu & Kashmir Assembly. "Throughout the years, a number of communities in the former state of Jammu & Kashmir experienced injustice, but their voices went unheard. The Modi government has now given these communities more clout because the elected MLAs can now speak out on their behalf in the Jammu & Kashmir Assembly, according to Raina.According to Ravinder Raina, these communities have endured numerous hardships over the years, including the displacement of communities from PoKK or Kashmir, but the Modi administration has now brought them justice. We are grateful to Prime Minister Modi and Union Home Minister Amit Shah for their sincere efforts on behalf of these underserved communities during the Modi administration. Raina stated, "The Modi government has worked for every section and done justice to them because they believe in the mission of 'Sabka Saath, Sabka Vikas, Sabka Vishwaas'." Raina went on to say that with the 33% reservation, the women would feel more empowered. PoJK refugees now experience empowerment. The Gujjar-Bakerwal and Gaddi-Sippi people have been granted political reservation, the SC ST Atrocities Act, and the Forest Rights Act. NC, Congress, and PDP plotted against these individuals in 2009, banning inter-district recruitment and displacing Gujjar-Bakerwals in the process. The Modi administration worked to bring justice to the Pahari community. He emphasised that their reservation will not take away any other community's allotment, emphasising that the Gujjar-Bakerwals' 10% reservation will not be diminished in any way. The OBC community, which is made up of about 40 subcastes, will also get justice. The PDP, Congress, and NC governments committed criminal injustice against this group for 70 years prior.In a similar vein, the Modi government's strong will would now guarantee justice for the Valmiki community. On behalf of all J&K citizens, Ravinder Raina praised the Modi government's choice and expressed gratitude to Amit Shah and PM Modi for the momentous choice. In reality, the Modi administration has brought justice to every community in Jammu and Kashmir that had been denied even the most basic of rights. He claimed that the government under Modi has worked to ensure the welfare of people from all walks of life and faiths. According to him, the people of Jammu and Kashmir have decided to support the BJP in the next Assembly election because they have a great deal of faith in the policies of the party and the Modi administration.According to him, the Modi administration has stated unequivocally that PoJK is ours, and the region has 24 seats set aside in the Jammu & Kashmir Assembly. In addition, he mentioned that PoJK Bhawan will soon be built nearby. [caption id="attachment_6865" align="alignnone" width="300"] Modi govt did justice to all sections in J&K: Raina[/caption]
