“It’s been 6 to 7 years, elections have still not happened in J&K”: Farooq Abdullah

NEW DELHI: Farooq Abdullah, the president of the National Conference, questioned on Monday why elections have not been held in Jammu and Kashmir, stating that the people living in Union Territory should receive justice in line with their status as citizens of India. Farooq Abdullah, the head of the National Conference, stated to reporters in Delhi that "Jammu and Kashmir still hasn't held elections." Six or seven years have passed. Why is it the case? We belong to India as well. Justice ought to be served to us as well." Farooq Abdullah went on to say that the INDIA bloc's parties have to step up their efforts in unison in light of the recent Assembly election outcomes in five states. "Victory and defeat are constants in life. We ought to take lessons from both wins and losses. The INDIA alliance will not be affected by this setback. We'll need to put forth more effort. Our work needs to be coordinated. We still have a ways to go," he remarked. Prime Minister Narendra Modi spoke to reporters prior to the start of the Parliamentary session, describing it as a "golden opportunity for opposition parties to do something constructive" and urging them not to use the House as a place to air their grievances over losing the assembly elections. "Negativity has been rejected by the nation. For my friends in the opposition, this is a fantastic opportunity. We urge and pray for the cooperation of everyone. The process has been carried out this time as well. PM Modi stated, "They should learn from this defeat, reject the idea of negativity that has been there for the last nine years, and approach the session with positivity, rather than venting their anger at defeat (in the assembly elections)." He added that strengthening the foundation of developed India and fostering public aspirations depend on the Parliament, the temple of democracy. Today marked the start of the Winter Session of the Parliament. Yesterday saw the announcement of the results of the Assembly elections in four states, with the Congress defeating the Bharat Rashtra Samithi (BRS) in Telangana and the BJP winning three (Chhattisgarh, Madhya Pradesh, and Rajasthan). On December 22, the Winter session will come to an end. [caption id="attachment_6738" align="alignnone"…

SC Notifies 5-Judge Bench For Reconsidering 2018 Verdict On Grant Of Stay By Courts

NEW DELHI, Dec 4: A five-judge Constitution bench led by Chief Justice D. Y. Chandrachud has been notified by the Supreme Court to reconsider its 2018 ruling, which held that a stay granted in a criminal or civil case by a lower court or high court will automatically expire after six months unless it is specifically extended. Justices Abhay S. Oka, JB Pardiwala, Pankaj Mithal, and Manoj Misra will serve on the Constitution bench, according a notice posted on the website of the supreme court. After the proceedings in another case pertaining to the constitutional validity of section 6A of the Citizenship Act concerning illegal immigrants in Assam are over, the Constitution bench will begin deliberating on the matter.On December 1, the highest court sent its 2018 ruling on court-granted stays back to a five-judge Constitution bench for review. Senior counsel Rakesh Dwivedi argued on behalf of the High Court Bar Association of Allahabad before a three-judge panel led by the Chief Justice of India. He said that the 2018 ruling removed the authority granted to high courts under Article 226 of the Constitution. High courts are granted broad authority under Article 226 of the Constitution, which allows them to impose writs and orders on any individual or government for the purpose of upholding basic rights and other objectives. In the Asian Resurfacing of Road Agency P Ltd Director vs. CBI case, a three-judge bench ruled that any temporary orders of stay issued by lower courts, including high courts, will automatically expire unless they are expressly extended. As a result, after six months, no trial or proceedings may be postponed. Later on, though, the highest court made it clear that if the stay order has been issued by it, the verdict will not be effective. The CJI-led bench first accepted Dwivedi's arguments and stated that since the top court's three-judge panel gave the contested decision, Dwivedi's petition would be heard by a five-judge bench. The bench cited the 2018 judgement's conclusions and stated that the directives meant that, in all cases—civil or criminal—orders of stay, once granted, should not be extended beyond six months unless expressly done so."We are not quite convinced that the broad articulation of the concepts in the aforementioned language is correct. The bench stated, "We believe that the principle established in the aforementioned decision—which states that a stay would automatically be vacated—is likely to lead to an injustice. Don’t Vent Frustration Of Assembly Polls Defeat Inside Parliament: PM Modi To Opposition

New Delhi, Dec 4: Prime Minister Narendra Modi asked the opposition to move past its "negativity" of the previous nine years and move forward, instead of expressing their frustration over the setback in the assembly polls within the House, ahead of Parliament's Winter Session on Monday. Speaking to the press outside the Parliament building, Modi declared that the nation had rejected negativity and that the opposition had a great opportunity during the Winter Session. "If I may base my remarks on the outcome of the assembly poll, opposition has a great chance to win.They should learn from this setback and break out from the negativity that has characterised the past nine years. If they go positively this session, the nation's perception of them will shift, he said, rather than organising ways to express their dissatisfaction over the loss. They might be able to enter a new area. Even though they disagree, I am still offering them counsel," he declared. "The future is bright for everyone, so don't give up hope. However, please don't take your displeasure with the losses you've experienced inside Parliament. He stated that there will be disappointment and frustration. The BJP tightened its grip over the Hindi heartland on Sunday by sweeping Madhya Pradesh, Rajasthan, and Chhattisgarh and handily defeating the Congress.In Telangana, the Congress defeated the Bharat Rashtra Samithi (BRS) to give the Bharatiya Janata Party (BJP) a 3-1 lead in the most recent Assembly elections, which are expected to serve as a semi-final before the national election in the following year. There will be fifteen sittings in the Winter session of Parliament until December 22. Jairam Ramesh, general secretary of the Congress, stated that the party's strong vote percentage in these states is cause for optimism and rebirth. "The Indian National Congress did not perform as well as we had hoped in Chhattisgarh, Madhya Pradesh, and Rajasthan. However, the vote shares show that the Congress is not far behind the BJP, in fact, it is within striking distance." This is the cause for optimism and rebirth, according to a post made by Ramesh on X.Giving specifics, he stated that the Congress had a 42.2 percent vote share in Chhattisgarh compared to the BJP's 46.3 percent. Don’t fall prey to deceit of traditional parties: Bukhari

SRINAGAR: Altaf Bukhari, the head of the Apni Party, has pleaded with people not to fall victim to the lies of established political parties any longer. He stressed unity and said that traditional politicians always use caste and creed to separate people in order to further their own political agendas. "The traditional politicians have been deceiving people to attain and retain power," Bukhari stated today, addressing a public protest in Nambla village, Uri, in northern Kashmir. For political purposes, they began segregating individuals on the basis of caste already in 1947. He rallied the populace, saying, "Enough is enough. It's time to maintain unity for your greater interests and to stop falling prey to deceptive politics any longer.""People who live on the borders have suffered greatly over the years simply because they were easy targets of firing and shelling from both sides," Bukhari said, recalling the deaths and destruction that the people of Uri had to endure over the years as a result of the confrontation between the armies on both sides. I hope that things will improve because history shows that peace and prosperity may start when adversaries choose to sever their hostility.""We've seen that throughout World War II, European countries engaged in combat and mutual deaths. But when they put an end to their fighting and committed themselves to achieving peace and prosperity, something amazing happened. These days, European nations are so harmonious that a single visa can be used to visit several countries. I hope that eventually there will be such a significant difference between these two nations and that everyone will feel relieved, especially those who live along the border," he continued. Zaffar Iqbal Manhas, the senior leader of the party and vice president, attacked the National Conference and Congress, holding them accountable for the suffering of those residing on the borders. Man has backed up his criticism with historical evidence.He declared, "We are aware that the hardship and anguish that border dwellers have endured over the past 70 years is entirely the fault of Sheikh Mohammad Abdullah and Pandit Jawaharlal Nehru. Junaid Mattu, a former Srinagar mayor, also spoke at the event.   [caption id="attachment_6702" align="alignnone" width="300"] Don’t fall prey to deceit of traditional parties: Bukhari[/caption]
