NEW DELHI, Feb 13: The new law, which calls for the Chief Election Commissioner and Election Commissioners to be appointed by a panel that does not include the Chief Justice of India, was not granted a stay of execution by the Supreme Court on Tuesday. The Association for Democratic Reforms, an NGO, filed a plea. A bench of Justices Sanjiv Khanna and Dipankar Datta noted the case for hearing in April along with other pending petitions on the subject. The bench sent notice to the Centre. The Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, was challenged in court as not being constitutionally valid.Representing the NGO, attorney Prashant Bhushan argued that the statute goes against the ruling of the Supreme Court's Constitution Bench, which stipulated that the CJI must be present on the committee that chooses the CEC and ECs. He stated that the request will become futile if the law's implementation is not stopped and that two election commissioners are about to retire. When Bhushan argued for an interim stay, the bench responded, "We know our parameters for granting interim relief."The new law stipulates that the President will appoint the Chief Election Commissioner and other Election Commissioners upon the recommendation of a Selection Committee made up of the following members: (a) the Prime Minister, who will serve as Chairperson; (b) the Leader of the Opposition in the House of People, who will serve as Member; and (c) a Union Cabinet Minister, who will be nominated by the Prime Minister, who will serve as Member. According to the plea, the law was passed in 2023 in order to fill the void created by Article 324(2) of the Indian Constitution."On the other hand, the challenged part reinstates the previous legal position, which states that the executive branch alone would appoint the Chief Election Commissioner and Election Commissioner. Prime Ministers and Union Cabinet Ministers who are nominated by the Prime Minister make up the majority of the selection committee, according to the statement. SRINAGAR: One terrorist who was involved in the attack on Punjabi migrant labourers who were killed in Central Kashmir's Srinagar area last week has reportedly been apprehended, according to Jammu and Kashmir Police on Tuesday. The ADGP Vijay Kumar said at a news conference that on February 7, 2024, at roughly 1900 hours, two people in Shalla Kadal, Shaheed Gunj Srinagar, were shot by unidentified terrorists. "In this incident, one Amritpal Singh S/o Sarmukh Singh R/o Chamyari succumbed to his injuries on spot," he stated. "Rohit Masi, S/o Parin Masi, R/o Chamyari, Amritsar, was taken to SMHS Hospital and subsequently to SKIMS Soura Srinagar for emergency care." Afterwards, on February 8, 2024, Rohit Masi passed away from his wounds," he claimed. It is important to note that Amritpal and Rohit were travelling to their lodging when they returned to Srinagar from Amritsar. "Srinagar Police detected the case leading to the identification of the accused who carried out the terrorist attack on these two individuals from Punjab and subsequent recovery of weapon of offence and other incriminating material," he continued. "Case FIR no. 08/2024 u/s 302, 307 IPC, 7/27 Arms Act, 15, 16, and 20 ULA(P) Act was registered in PS Shaheed Gunj." "Technical and field analysis allowed Srinagar Police to focus on a few suspects. Later, on the basis of compelling evidence gathered throughout the inquiry, they identified and detained the primary accused, Adil Manzoor Langoo, son of Manzoor Ahmad Langoo, Rio Zaldager Srinagar.The accused and his handler in Pakistan were found to have plotted together to commit the terror crime, according to the ADGP. He described the accused as a radicalised and extremely motivated person. According to him, his handler in Pakistan incited him to do the terror assault on social media. "The handler gave him the weapon to promote the plot, and then he inspired him to carry out the attack. To further this, the accused named his targets, followed them around Shalla Kadal's lanes on the fatal day, and opened fire on them both; as a result, they both died from their wounds," he continued. Relevantly, TRF, an affiliate of LeT, has taken credit for this attack on their social media page. In the meantime, the DIG CKR has formed a SIT under the direction of SP South to look into the situation, and more research is being done quickly.
