The company and its chief promoter were charged on several counts by the federal probe agency. These counts included "failing" to submit import documents against advance remittances made outside of India and failing to realise export proceeds by delaying filing documents against foreign direct investment (FDI) received by the company. The statement stated that a show-cause notice regarding the violations of the Foreign Exchange Management Act (FEMA) to the tune of Rs 9,362.35 crore has been sent to Raveendran and the registered company of BYJU's, Think & Learn Private Limited. The ED may fine FEMA violators up to three times the amount specified in the show cause notice following the final adjudication. The agency claimed that after conducting searches at three locations in April, including Raveendran's home in Bengaluru, it recorded statements made by the chief financial officer of BYJU and Raveendran. It said the action was taken in response to complaints about Think & Learn Private Limited's "business conduct" and the foreign investment it had received. According to the ED, the company was accused of making large foreign investments and remittances outside of India in violation of the terms of the FEMA, 1999, resulting in revenue losses for the Indian government.The ED stated that after conducting the investigation, it was discovered that Think & Learn Private Limited and Raveendran had "contravened" the FEMA provisions by neglecting to file import documents against advance remittances made outside of India, failing to realise export proceeds made outside of India, delaying the filing of documents against Foreign Direct Investment (FDI) received by the company, failing to file documents against FDI received by the company, and failing to allot shares against FDI received by the company. The Enforcement Directorate (ED) declared following the searches in April that "the company (Think & Learn Pvt. Ltd.) has not prepared its financial statements since 2020-21 fiscal and has not got the accounts, audited which is mandatory." According to the searches, the company received approximately Rs 28,000 crore in foreign direct investment (FDI) between 2011 and 2023. "The company also remitted about Rs 9,754 crore to various foreign jurisdictions during the same period in the name of overseas direct investment," according to the agency. The ED claimed that the company recorded marketing and advertising costs totaling approximately Rs 944 crore, including money sent to overseas jurisdictions. In addition to offering early learning, middle school education, and test preparation, the Bengaluru-based company was co-founded by Raveendran Bjyu and his spouse, Divya Gokulnath. SC cautions Patanjali against making ‘false’ claims about its medicines in advertisements

NEW DELHI: On Tuesday, the Supreme Court issued a warning to Patanjali Ayurved, a herbal product company that was co-founded by yoga guru Ramdev, about making "false" and "misleading" claims in their advertisements regarding the cure of various diseases with their medicines. "Patanjali Ayurved needs to stop its deceptive and false advertising right away. During an oral hearing on a plea from the Indian Medical Association (IMA), a bench made up of justices Ahsanuddin Amanullah and Prashant Kumar Mishra stated, "The court will take any such infraction very seriously." On August 23, 2022, the Supreme Court sent notices to the Union Health Ministry, the Ministry of Ayush, and Patanjali Ayurved Ltd. This was in response to the IMA's plea, which claimed that Ramdev had launched a smear campaign against the vaccination campaign and contemporary medications. The bench requested that Patanjali Ayurved refrain from publishing deceptive statements and advertisements disparaging contemporary medical systems during the brief hearing. According to the statement, the bench might also think about fining each product Rs 1 crore in the event that a false claim is made about its ability to treat a specific illness. The highest court requested that the Center's attorney look into a solution for the problem of deceptive medical advertising that make claims about medications that provide a 100% cure for specific illnesses. The bench will now hear the IMA's plea on February 5 of the following year. The Supreme Court severely criticised Ramdev for criticising allopathy and allopathic practitioners, saying he should be prevented from mistreating medical professionals and other treatment modalities, while also issuing notices regarding the plea. "Whatever became of this Swami Ramdev Baba, the Guru? In the end, we honour him because he made yoga more widely known. Everyone aims for this. He shouldn't, however, be critical of the other system. What is the assurance that the Ayurvedic system he is using will be effective? Advertisements that portray all doctors as murderers or something similar are common. Huge ads (have been given)," the bench led by the now-retired CJI N V Ramana stated at the time. IMA had cited multiple ads that purportedly painted the allopath and the physicians in a negative light, alleging that companies that produce ayurvedic medicines have also made "disparaging" remarks in an effort to deceive the public. The IMA's legal representative stated that these commercials claim that doctors are dying even though they take modern medications. According to IMA, a deliberate attempt is being made to dissuade the nation from using allopathic medicines and from getting immunised, including through the COVID-19 vaccine drive.   [caption id="attachment_5946" align="alignnone" width="300"] SC cautions Patanjali against making 'false' claims about its medicines…

‘1 Nation, 1 Election’ In National Interest, Nothing To Do With Any Party: Kovind

Rae Bareli, Nov 21: Holding simultaneous polls is in the best interests of the country and has nothing to do with any one political party, according to former president Ram Nath Kovind, who also serves as the head of the committee investigating the possibility of "one nation, one election." "The public will benefit from simultaneous elections because the money saved will be used for development projects," the former president told reporters on a private visit to this area on Monday night. It is in the best interests of the country, so I am asking all political parties to work together. He emphasised that it has nothing to do with any political party.The eight-member high-level committee, led by Kovind, was established by the government earlier this year. The parliamentary committee, Niti Aayog, the Election Commission of India, and other committees have all stated that the nation needs to revive the tradition of "one nation, one election." The former president made this statement. "A committee has been established by the government with me serving as its chairman for this purpose. He stated, "We are collaborating with the populace and will make recommendations to the authorities regarding the revival of this custom. "I have also gotten in touch with every national party that has registered to ask for their advice. They were all in favour of it at one point. As this is in the best interests of the country, we kindly ask all political parties to collaborate," he said. Declaring that "one nation, one election" would not benefit any one political party, Kovind stated, "If implemented, the party which is in power at the Centre, be it the BJP or the Congress or any other party, will benefit." There isn't any prejudice. The general public will gain the most since Kovind stated that the money saved will be used for development projects.The committee decided to invite recognised national parties, state-level political parties, parties with representatives in parliament, and other recognised state parties to discuss the idea of holding simultaneous elections nationwide during its first meeting in September. The panel also discussed the committee's procedures. Furthermore, it stated that the Law Commission of India will be invited by the Committee to share their ideas and opinions on the matter. The decision to assign Kovind the task of investigating concurrent Lok Sabha and state assembly polls is a testament to the government's seriousness as elections draw near. Prime Minister Narendra Modi has long championed the idea of holding these polls simultaneously. Caste census is ‘X-ray’ of country, Congress will conduct it: Rahul at Rajasthan poll rally

RAJASTHAN: Rahul Gandhi, the Congress leader, promoted the caste census on Tuesday, calling it a national "X-ray." "How will we talk about participation if it is unknown whose population is how much?" he asked at an election rally in Vallabhnagar, Udaipur. Gandhi stated that if the Congress wins power, it will carry out a caste census in Rajasthan and nationwide if it forms the federal government. On the matter, he attacked Prime Minister Narendra Modi, claiming that while in the past the PM had claimed to be an OBC, on the day Gandhi brought up the demand for a caste census, Modi began asserting that there is only one caste in India: the poor. "Modi claimed that there was only one caste in the nation—the poor—but he made no mention of the existence of a second caste, which consists of billionaires. That's the caste of Adani, Ambani. They belong to a unique caste," he remarked. The former head of the Congress accused Modi of using his position to distract the public while Adani commits pickpocketing, saying that "they are a team".
