JMC Commissioner : Demolition at Dashmesh Nagar, Digiana carried out as per HC verdict

JAMMU : JMC, Rahul Yadav has said that the demolition of a House by JMC at Saw Mill Road, Dashmesh Nagar, Digiana was undertaken by JMC as per the HC Verdict.The house was built by Ramesh Chander Gupta, a descendant of Durga Prasad Gupta. He accused JMC of violently demolishing his home without giving him prior notice. The Commissioner of JMC said that JMC had issued a notice under section 7(3) in 2009 in response to Ramesh Chander Gupta’s assertion made in the media, to which Ramesh Chander Gupta responded by filing a petition with the Hon’ble Tribunal. He lost his lawsuit before the Hon’ble Tribunal in 2012, and a decision in favour of the Jammu Municipal Corporation was made.The Special Tribunal’s ruling was appealed to the High Court by the aforementioned Ramesh Chander Gupta, and ten years later, the High Court decided in Jammu Municipal Corporation’s favour. The Commissioner of JMC further explained that the demolition was carried out in accordance with the High Court’s ruling and that Ramesh Chander Gupta’s accusations are completely unfounded and not supported by any evidence. He went on to say that the person who carried out the unauthorised construction is responsible for the expense of demolition and debris clearance, and that amount will be recovered from him.
