NEW DELHI:Rahul Gandhi<\/a> was relieved when the SC<\/a> issued an interim injunction on Friday staying his conviction in the criminal defamation case involving the ‘Modi<\/a> surname’ statement.The appeal filed by the Congress leader to overturn the Gujarat High Court’s<\/a> decision to not grant a stay of his conviction in the criminal defamation case was heard by the Supreme Court earlier in the day. Senior attorney Abhishek Manu Singhvi, who represented Rahul Gandhi, was informed by the supreme court that he must present an unusual case in order to obtain a stay of execution. Purnesh Modi, the complainant, did not originally have the last name “Modi,” according to Singhvi, who claimed that he later adopted it.”None of the people Gandhi mentioned in his speech have filed a lawsuit. There is no uniformity or homogeneity in this tiny society of 13 crore people. Only BJP office holders who have filed lawsuits are the ones who feel wronged in this group, according to Singhvi. Singhvi stated that the judge views this as a serious criminal including moral turpitude in reference to the earlier decision rendered in the case by the lower court. “This is a non-cognizable offence that is bailable and compoundable. No crimes against society, such as kidnapping, rape, or murder, were committed.He questioned, “How can this be a crime including moral turpitude? “In a democratic society, there is dissent and debate. what we refer to as “shaleen bhasha.” Gandhi is not a seasoned felon. BJP members have brought numerous cases, yet no one has ever been found guilty. Gandhi has now skipped two Parliamentary sessions, he continued. On an appeal from the Congress leader disputing the Gujarat High Court judgement, the top court sent notifications to the Gujarat government and the complainant in July. Rahul Gandhi was convicted to two years in prison by the Surat court in the criminal defamation case in which he made the statement about the “Modi surname” and the Gujarat High Court had declined in its ruling to stay his conviction. Rahul Gandhi was found guilty in March by the magisterial court for his comments on the “Modi” surname prior to the 2019 presidential election.<\/p>\n
